Welcome to Food Handlers of Texas. By accessing our website and enrolling in our certification courses, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before using our services.
1. Acceptance of Terms
By accessing or using foodhandlersoftexas.com, enrolling in any course, or purchasing any certification, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.
These terms constitute a legally binding agreement between you ("User," "Student," or "you") and Food Handlers of Texas ("Company," "we," or "us").
2. Eligibility Requirements
To use our services, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction)
- Be legally authorized to work in the United States
- Provide accurate and complete registration information
- Have a valid email address and phone number
- Comply with all Texas state regulations regarding food handler and TABC certifications
By registering, you represent and warrant that you meet these eligibility requirements.
3. Course Enrollment and Access
Registration
To enroll in a course, you must create an account by providing:
- Full legal name (as it appears on your government-issued ID)
- Date of birth
- Email address and phone number
- Mailing address
- Payment information (credit card or other accepted payment method)
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Course Access
Upon successful payment, you will receive immediate access to your purchased course. Access includes:
- 24/7 online course materials
- Unlimited exam retakes (where applicable)
- Course access for 90 days from purchase date
- Customer support during business hours
- Official certificate upon course completion
Account Sharing Prohibited
Each enrollment is for individual use only. You may not:
- Share your login credentials with others
- Allow multiple people to use the same account
- Transfer your enrollment to another person
- Access the course from multiple devices simultaneously
Violation of this policy may result in immediate account termination without refund.
4. Course Completion and Certification
Exam Requirements
To receive certification, you must:
- Complete all required course modules
- Pass the final exam with a minimum score of 70% (food handler) or 75% (TABC)
- Complete the course personally (no proxy test-takers)
- Provide accurate identification information
Certificate Issuance
Upon successful course completion:
- Your certificate will be available for immediate download
- A physical certificate will be mailed within 3-5 business days (if applicable)
- Your information will be submitted to Texas DSHS or TABC as required by state law
- Your certificate is valid for 2 years (food handler) or as specified by regulation
Certificate Validity
Your certificate is valid only if:
- You personally completed the course and exam
- All information provided is accurate and truthful
- The certificate has not expired or been revoked
- You comply with all Texas regulatory requirements
5. Payment and Pricing
Course Fees
All course prices are displayed in U.S. dollars and are subject to change without prior notice. Current pricing includes:
- Texas Food Handler Certificate: $9.99
- TABC Seller-Server Certification: $9.99
- Food Manager Certification: $99.95
- Bundle packages with discounted pricing
Prices include all course materials, unlimited exam attempts, digital certificate, and physical certificate mailing (where applicable).
Payment Methods
We accept the following payment methods:
- Visa, Mastercard, American Express, Discover
- Debit cards with Visa/Mastercard logo
- Corporate purchase orders (for bulk orders only)
All payments are processed securely through PCI DSS-compliant payment processors. We do not store credit card information on our servers.

6. Refund Policy
We offer a satisfaction guarantee with the following refund conditions:
Full Refund Eligibility
You may request a full refund if:
- You have not accessed any course materials beyond the first module
- You have not attempted the final exam
- Your request is submitted within 30 days of purchase
- No certificate has been issued
No Refund Situations
Refunds will not be issued if:
- You have completed the course and received your certificate
- You have failed the exam multiple times
- More than 30 days have passed since purchase
- You violated our terms of service
- You provided false information during enrollment

7. User Conduct and Prohibited Activities
You agree not to:
- Cheat or commit fraud: Use unauthorized materials, get help from others during exams, or provide false information
- Violate intellectual property: Copy, reproduce, distribute, or sell our course materials without permission
- Hack or abuse systems: Attempt to gain unauthorized access, disrupt services, or exploit vulnerabilities
- Impersonate others: Take the course or exam on behalf of another person
- Harass or threaten: Engage in abusive behavior toward our staff or other users
- Spam or solicit: Use our services for unauthorized marketing or commercial purposes
Violation of these terms may result in immediate account suspension, certificate revocation, and reporting to appropriate authorities.
8. Intellectual Property Rights
Our Content
All course materials, including text, images, videos, quizzes, and exams, are protected by U.S. copyright law and are the exclusive property of Food Handlers of Texas. This includes:
- Course curriculum and lesson content
- Exam questions and answers
- Video presentations and graphics
- Website design and functionality
- Trademarks, logos, and branding
Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our course materials solely for personal, non-commercial purposes. You may not:
- Copy, download, or reproduce course materials (except your certificate)
- Share, sell, or distribute our content
- Create derivative works based on our materials
- Remove copyright notices or watermarks
9. Texas Regulatory Compliance
DSHS Approval (Food Handler)
Food Handlers of Texas is an approved food handler training provider by the Texas Department of State Health Services (DSHS Provider #38776). Our courses comply with:
- Texas Food Establishment Rules (25 TAC §229)
- Texas Health and Safety Code Chapter 438
- DSHS Food Handler Training Program standards
TABC Approval (Alcohol Seller-Server)
We are an approved TABC seller-server training provider (TABC Provider #454-508). Our TABC course complies with:
- Texas Alcoholic Beverage Code
- 16 Texas Administrative Code §3.94
- TABC certification requirements
Student Responsibilities
You are responsible for:
- Verifying that our certificate meets your employer's requirements
- Ensuring your certificate is current and valid
- Renewing your certification before expiration
- Complying with all applicable Texas food safety and alcohol laws
Note: Certification does not guarantee employment or job placement.
10. Disclaimers and Limitation of Liability
Course Disclaimer
Our courses are designed to meet Texas state requirements. However:
- We do not guarantee exam passage or employment
- Course content is subject to change based on regulatory updates
- You are responsible for verifying your employer's specific requirements
- We are not responsible for technical issues beyond our control (internet outages, browser compatibility, etc.)
Service "As Is"
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Uninterrupted or error-free service
- Accuracy or reliability of course materials
Limitation of Liability
IMPORTANT: TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOD HANDLERS OF TEXAS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Lost profits, lost revenue, or lost business opportunities
- Employment termination or job-related consequences
- Technical failures, data loss, or system downtime
Our total liability is limited to the amount you paid for the course (typically $9.99-$99.95).
11. Indemnification
You agree to indemnify, defend, and hold harmless Food Handlers of Texas, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms of Service
- Your use or misuse of our services
- Your violation of any law or regulation
- Your infringement of any third-party rights
- False information provided during registration
12. Dispute Resolution and Arbitration
Informal Resolution
If you have a dispute, please first contact us at support@foodhandlersoftexas.com to attempt an informal resolution.
Binding Arbitration
If informal resolution fails, any dispute arising from these terms shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, rather than through court litigation.
Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive the right to participate in class actions, class arbitrations, or representative actions.
Texas Jurisdiction
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any arbitration or litigation shall take place in Texas.
13. Changes to Terms of Service
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. We will notify users of material changes by:
- Updating the "Last Updated" date at the top of this page
- Sending email notification to registered users
- Displaying a prominent notice on our website
Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
14. Account Termination
Termination by You
You may terminate your account at any time by contacting customer support. Termination does not entitle you to a refund unless you meet our refund policy criteria.
Termination by Us
We reserve the right to suspend or terminate your account immediately, without notice, if you:
- Violate these Terms of Service
- Engage in fraudulent activity
- Provide false information
- Abuse our services or staff
- Fail to pay required fees
Upon termination, your access to courses and materials will be revoked, and any certificates may be invalidated.
15. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable by a court of law, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between you and Food Handlers of Texas regarding use of our services.
